Terms and Conditions for Your Autumn Qigong Flow Journey with Jessica

Welcome to Zen BODY Flow! These Terms and Conditions ("Terms") govern your purchase and use of our digital product, the "Autumn Qigong Flow Journey" – a 6-part video class ("Product") – available through zenbodyflow.com. By purchasing or accessing the Product, you agree to be bound by these Terms. If you do not agree, please do not purchase or access the Product.

These Terms apply in addition to the terms of our sales partner, Digistore24 AG (the "Seller"), who processes all purchases. Digistore24's terms and conditions are available at [https://www.digistore24.com/terms] and govern payment, delivery, and refunds where applicable. In case of conflict, Digistore24's terms prevail on sales-related matters.

1. Definitions

• "We," "Us," or "Our" refers to Jessica Moritz, a freelancer (Freiberufler) based in Germany, operating under tax number DE 286430091.

• "You" or "Your" refers to the individual purchasing or using the Product.

• "Product" or "Journey" refers to our 6-part Qigong video class, accessible via our website and YouTube platform.

• "Seller" refers to Digistore24 AG.

2. Purchase and Payment

• Eligibility: You must be at least 18 years old to purchase the Product. By purchasing, you confirm you meet this requirement and that you are purchasing for personal use.

• Pricing: The promotional price for the Product is €29. As a freelancer under German law (§19 UStG), we do not charge VAT. The Seller (Digistore24) may add VAT for EU customers based on your location, as required by EU law. “This is a limited-time promotional price, subject to change after November 9th, 2025.”

• Payment: ll payments are processed securely by the Seller (Digistore24) using supported methods such as credit card, PayPal, or other options they provide. You agree to provide accurate payment information and authorize the Seller to charge the listed price.

• Currency: Transactions are in [e.g., EUR or USD]. You are responsible for any currency conversion or bank fees.

• Pre-Purchase Information: Before purchase, we provide clear details on the Product, price, delivery (immediate access), and your refund rights, as required by EU Consumer Rights Directive (2011/83/EU).

3. Delivery of Digital Product

• Upon successful payment via the Seller, you will receive immediate access to the Product via a unique login on our website and embedded YouTube links.

• Access is granted for 6 months from the date of purchase ("Access Period"). After the Access Period, access will expire, but you may request an extension at our discretion for a fee.

• We are not responsible for delays due to issues with the Seller, your internet connection, or technical problems beyond our control. You are responsible for providing accurate email and

  account details for delivery.

4. License and Usage Rights

• License: Upon purchase and during the Access Period, we grant you a non-exclusive, non-transferable, revocable, limited license to access and view the Product for your personal, non-commercial use only.

• Access Methods: You may view the videos on our website or via the provided YouTube links. No downloads are permitted.

• Restrictions: You may not:

  • Share, distribute, lend, or sublicense access to the Product (e.g., no sharing login credentials or links).

  • Resell, rent, or commercially exploit the Product in any way.

  • Record, copy, screenshot, or reproduce any part of the Product (e.g., no unauthorized downloads or screen captures).

  • Use the Product in violation of these Terms, applicable laws, or third-party rights (e.g., YouTube's terms).

• Violation of these restrictions may result in immediate termination of access and legal action.

5. Refund Policy

• All Customers (EU and Non-EU): We offer a 60-day refund policy. You may request a full refund for any reason within 60 days from the date of purchase by contacting the Seller (Digistore24) via their support portal. Refunds are processed by the Seller within their standard timeframe to your original payment method, excluding any processing fees charged by the Seller.

• Note: Refunds are handled by Digistore24, and their terms may apply to the process. Contact the Seller or us for assistance.

6. Intellectual Property

• The Product, including all videos, content, materials, and designs, is owned exclusively by Jessica Moritz and protected by copyright, trademark, database rights, and other intellectual property laws under German, EU, and international law.

• Your purchase grants only the limited license in Section 4; no ownership or transfer of IP rights occurs. Unauthorized copying, distribution, or theft of the Product (e.g., via piracy or sharing) is strictly prohibited and may result in civil and criminal penalties, including damages claims up to three times the Product's value.

• We actively monitor for infringement and reserve the right to report violations to authorities (e.g., YouTube for unauthorized uploads).

7. Privacy and Unsubscribe Instructions

• Your personal data is handled in accordance with our Privacy Policy, available at www.zenbodyflow.com/data-privacy.

• Unsubscribe Instructions: If you receive marketing communications (e.g., newsletters) from us, you can unsubscribe at any time by clicking the “Unsubscribe” link at the bottom of any email or by contacting us at info(at)zenbodyflow.com. You may also manage your preferences through your account on our website, if applicable. We will process your unsubscribe request promptly in compliance with GDPR and German data protection laws.

8. Limitation of Liability

• The Product is provided "as is" without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.

• To the maximum extent permitted by law, Jessica Moritz and the Seller are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Product (e.g., lost profits or data loss).

• Our total liability for any claim related to the Product will not exceed the amount you paid for it.

• For EU consumers, liability for death, personal injury, or fraud cannot be limited.

9. Termination

• We or the Seller may terminate your access to the Product immediately if you violate these Terms (e.g., sharing or unauthorized copying).

• Upon termination or expiration of the Access Period, you must cease all use and delete any temporary views or notes. Sections 4, 6, 7, 8, and 10 survive termination.

10. Governing Law and Dispute Resolution

• These Terms are governed exclusively by the laws of the Federal Republic of Germany, excluding conflict of laws rules. For EU consumers, mandatory local consumer protection laws apply in addition.

• Any disputes arising from these Terms will first be attempted to be resolved amicably. If unresolved, they shall be submitted to the competent courts in [Insert Your City, e.g., Berlin], Germany. EU consumers may also use the EU Online Dispute Resolution platform or contact the German Consumer Advice Centre (Verbraucherzentrale).

• For US consumers, we encourage informal resolution but agree to German jurisdiction for efficiency.

• We may update these Terms at any time to reflect legal changes or Product updates. The updated version will be posted on our website with the "Last Updated" date. Continued access to the Product after changes constitutes your acceptance. We will notify you of material changes via email.
